These Terms of Service ("Terms") govern your access to and use of all services provided by Arkline AI, including the PerilWatch platform (perilwatch.arkline.ai), the Command dashboard (command.arkline.ai), the main website (arkline.ai), and any related subdomains, applications, or APIs (collectively, the "Services").

By accessing or using any of the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

We may modify these Terms at any time. Continued use of the Services after changes constitutes acceptance of the updated Terms.

1. Description of Services

Arkline AI provides real-time peril intelligence and portfolio management tools for property & casualty (P&C) insurance professionals:

  • PerilWatch: Real-time monitoring of weather alerts, wildfires, earthquakes, civil unrest, and other perils; Atomic Risk Factor (ARF) scores; historical event archives; forecasting; AI-generated summaries; and API access.
  • Command: A portfolio overlay dashboard that integrates PerilWatch data with user-provided policy information (e.g., Statements of Values, locations) to enable exposure calculations, accumulation views, marginal impact analysis, and audit trails.

The Services are informational tools only and are not substitutes for professional underwriting, risk modeling, or regulatory compliance processes.

2. User Accounts

To access paid or restricted features, you must create an account. You agree to:

  • Provide accurate, complete registration information
  • Maintain the security of your credentials
  • Notify us immediately of unauthorized access
  • Accept responsibility for all activities under your account

We may suspend or terminate accounts for violations of these Terms.

3. Subscription and Payment

The Services include free and paid tiers (e.g., PerilWatch Sentinel, Enterprise; Command access via subscription or custom plans).

For paid subscriptions:

  • Fees are charged in advance (monthly or annual)
  • Subscriptions auto-renew unless cancelled
  • Refunds follow our refund policy
  • Pricing changes require 30 days' notice for existing subscribers

4. Acceptable Use

You agree not to:

  • Use the Services for unlawful purposes
  • Attempt unauthorized access
  • Interfere with or disrupt the Services
  • Scrape, copy, or redistribute content without permission
  • Exceed API limits or resell access
  • Upload false, misleading, or infringing data (e.g., policy information)
  • Misrepresent affiliation with any entity

5. User Content (Command-Specific)

In Command, you may upload policy data, Statements of Values (SoVs), locations, or other information ("User Content").

You represent that you have all rights to upload and use this User Content. You grant Arkline AI a limited, non-exclusive license to process it solely to provide the Services (e.g., overlays, exposure calculations).

We do not claim ownership of User Content but are not responsible for its accuracy, legality, or loss. You should back up critical data.

6. Data and Information

The Services aggregate third-party data (e.g., NOAA, NASA, USGS, news sources) and process User Content.

All data and outputs (including ARFs, forecasts, exposure calculations) are provided "as is" without warranties of accuracy, completeness, or timeliness. Users must verify critical information independently.

Historical data and forecasts are limited by source availability and are not exhaustive.

7. Intellectual Property

The Services, including content, features, ARF methodologies, algorithms, and derived data, are owned by Arkline AI and protected by copyright, trademark, and other laws.

You receive a limited, non-exclusive, non-transferable license to use the Services for internal business purposes only.

8. API Terms

API users (available in certain tiers) must:

  • Comply with rate limits and guidelines
  • Keep API keys confidential
  • Attribute data appropriately
  • Accept potential suspension for violations

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, INCLUDING:

  • Merchantability or fitness for a particular purpose
  • Accuracy or reliability of data, scores, or calculations
  • Uninterrupted or error-free operation

We do not guarantee the Services will meet your requirements or that outputs are suitable for underwriting, pricing, or regulatory decisions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKLINE AI SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of profits, data, or goodwill
  • Damages from reliance on the Services (e.g., peril data, exposure overlays)
  • Errors in user-uploaded content or third-party sources

Our total liability is limited to amounts paid by you in the 12 months preceding a claim.

11. Indemnification

You agree to indemnify Arkline AI and its affiliates from claims arising from:

  • Your use of the Services
  • Your User Content
  • Violations of these Terms or third-party rights

12. Termination

We may terminate or suspend access immediately for any reason, including breaches. Upon termination:

  • Access rights cease
  • We may delete accounts and associated data
  • Surviving provisions (e.g., liability, IP) remain in effect

13. Governing Law

These Terms are governed by the laws of England and Wales (reflecting our London base), without regard to conflict of law principles.

14. Dispute Resolution

Disputes shall be resolved in the courts of England and Wales. We may seek injunctive relief for IP violations.
